Terms of Service

1. What This Covers

These terms govern your use of Echo Memory, a persistent memory service for AI agents, operated by Textstone Labs LLC ("we", "us", "our"). By using Echo Memory (the "Service"), whether cloud-hosted or self-hosted, you agree to these terms.

2. The Service

Cloud-hosted: We provide a hosted API at echo-memory.fly.dev where you can store, search, and retrieve memories. Your data is stored on Fly.io infrastructure in the US-East region.

Self-hosted: We provide a downloadable Go binary that you run on your own hardware. Your data stays on your machine. We have no access to it.

3. Your Data

You own your data. We do not use your memories to train AI models. We do not sell your data. We do not share your data with third parties except as required to operate the service (Fly.io for hosting, Stripe for billing).

Cloud-hosted data: We store your data on Fly.io infrastructure. We implement reasonable security measures including API key authentication, tenant isolation, and encrypted connections (HTTPS). We do not guarantee zero data loss. Back up anything critical.

Self-hosted data: Your data, your responsibility. We provide the software. You manage backups, security, and access control.

4. Accounts and API Keys

You are responsible for keeping your API key secure. Do not share it, commit it to public repositories, or embed it in client-side code. If you believe your key is compromised, contact us immediately.

5. Acceptable Use

Don't use Echo Memory to store or process: illegal content, malware, content that violates others' rights, or content intended to harm others. Don't attempt to access other tenants' data, bypass rate limits, or reverse-engineer the service.

6. Pricing and Billing

Cloud tiers: Free (1,000 memories), Pro ($29/month), Team ($99/month). Prices may change with 30 days notice. Existing subscriptions are honored through the current billing period.

Self-hosted: One-time purchase of $49. Includes lifetime updates. No refunds after download, as the product is a downloadable binary.

Billing is handled through Stripe. We do not store your credit card information.

7. Service Availability

Echo Memory is in beta. We aim for high availability but do not guarantee uptime. The service may be interrupted for maintenance, updates, or unforeseen issues. We are not liable for downtime or data loss during the beta period.

8. Termination

You can delete your account at any time by contacting us. We may suspend or terminate accounts that violate these terms. On termination, your data will be deleted within 30 days.

9. Limitation of Liability

Echo Memory is provided "as is" without warranties of any kind. Textstone Labs LLC is not liable for any damages arising from your use of the service, including data loss, business interruption, or lost profits. Our total liability is limited to the amount you paid us in the 12 months before the claim.

10. Changes to These Terms

We may update these terms. Material changes will be communicated via email or a notice on the service. Continued use after changes constitutes acceptance.
